Terms of use
1. Agreement
By creating an account or using gardencloud.app (the “Service”) you agree to these terms and to our privacy policy. If you don’t agree, don’t use the Service. You must be at least 16 years old.
2. Your account
Authentication is provided through Auth0. You are responsible for activity under your account and for keeping your sign-in method secure. We may suspend accounts that violate these terms.
3. Your content
You keep ownership of everything you post — photos, videos, notes, listings. You grant us a worldwide, non-exclusive license to host, process (including generating thumbnails and running safety screening), and display that content as needed to operate the Service and according to the visibility you choose for it. You are responsible for having the rights to what you upload.
4. Acceptable use
- No unlawful content or conduct, harassment, hate, or sexually explicit material.
- Prohibited plants: cannabis/marijuana and other controlled drug-source plants may not be added to collections or bought, sold, or traded on the Service. Some additional regulated species are restricted from the marketplace; the Service will tell you when a listing is blocked or requires acknowledgment.
- No spam, scraping at abusive rates, malware, or attempts to bypass rate limits or moderation.
- No misrepresenting plants, their identity, provenance, or legality.
Uploads and messages are screened by automated moderation systems; flagged content may be hidden pending review, and repeated violations may lead to suspension. You can appeal moderation decisions from the content itself or by contacting support.
5. Subscriptions
The free tier includes up to 10 active plants. GardenCloud Pro ($9.99/month, plus any applicable taxes) unlocks unlimited plants and other benefits, billed through Stripe until cancelled. You can cancel anytime from Settings; access continues to the end of the paid period. If Pro lapses, plants beyond the free limit become read-only — nothing is deleted.
6. Marketplace and trades
When marketplace features are available, sales and trades are contracts between buyer and seller; GardenCloud is a venue, not a party. A separate marketplace addendum (presented at first use) covers fees — 10% of cash amounts; item-for-item swaps are free — payouts, refunds, and disputes.
Shipping live plants is regulated. Sellers and buyers are solely responsible for complying with applicable law, including CITES permits, phytosanitary certificates, and import/export rules. We provide informational guides only; GardenCloud accepts no liability for shipments delayed, seized, or destroyed by customs or agricultural authorities, or for any regulatory penalty arising from a trade.
7. Disclaimers
The Service is provided “as is” without warranties of any kind. Plant identification is AI-assisted and probabilistic — verify before you ingest, sell, or ship anything. Care information is community- and machine-generated and is not professional advice.
8. Limitation of liability
To the maximum extent permitted by law, Snizyx Software LLC’s total liability arising out of the Service is limited to the greater of $100 or the amounts you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages, or for loss of plants, data, or profits.
9. Termination
You may delete your account at any time from Settings. We may suspend or terminate accounts for violations of these terms, with notice where practicable.
10. Changes; governing law
We may update these terms; material changes will be announced in the app and take effect no sooner than 14 days after posting. These terms are governed by the laws of the state in which Snizyx Software LLC is organized, excluding conflict-of-law rules.
